This End-User License Agreement ("EULA") is a agreement between you and we for using Gofitness.

BY INSTALLING OUR SOFTWARE ON YOUR PHONE, YOU ARE INDICATING YOUR AGREEMENT TO BE BOUND BY ALL OF THE TERMS AND CONDITIONS OF THE AGREEMENT BELOW. READ THE AGREEMENT CAREFULLY AS IT SETS FORTH YOUR RIGHTS AND OBLIGATIONS WITH RESPECT TO USE OF THE SERVICE. IF YOU ARE NOT WILLING TO BE BOUND BY THE TERMS AND CONDITIONS OF THIS AGREEMENT, YOU SHOULD UNINSTALL THE SOFTWARE.

1.PROPRIETARY RIGHTS

All content in the software is owned or controlled by Us or where started otherwise, and is protected by worldwide copyright, trademark and other proprietary laws.
All content and information in the software including, without limitation, text, graphics, photos, images, sounds, video clips, promotional contests, interactive features, software and code, (collectively, "Content") is owned by the Company or where stated otherwise, a third party and is protected by copyright and other intellectual property laws. All branding, trademarks, services marks and logos contained in the software (collectively, "Marks") are the exclusive property of us or where stated otherwise, third parties. The Content is provided to you "AS IS" for your information and may not,in whole or in part,be copied,modified, reproduced, distributed, transferred, transmitted,broadcasted,published,displayed,sold,licensed,or otherwise exploited in any manner and for any purpose whatsoever,without except in accordance with these Terms of Use.

2.LICENSE

Subject to the terms and conditions of the EULA, We grants to End User a non-exclusive, non-transferable,limited license to use the Software during the term of this EULA.

3.RESTRICTIONS

End User agrees not to do any of the following:(a)Copy the Content,except as specifically described in this Agreement;(b)Translate the Content;(c)Merge the Content with another program or modify Content;(d)Sublicense,rent, or lease any portion of the Content of for any purposes other than those set forth in this Section.

4.DISCLAIMER OF WARRANTIES

THE COMPANY PROVIDES THE SOFTWARE ON AN "AS IS" AND "AS AVAILABLE" BASIS, AND END USER USES SUCH SOFTWARE AT THEIR SOLE RISK. THE COMPANY MAKES NO WARRANTY THAT THE SOFTWARE WILL MEET END USER'S REQUIREMENTS, OR THAT THE SOFTWARE WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR FREE; NOR DOES THE COMPANY MAKE ANY WARRANTY AS TO THE RESULTS THAT MAY BE OBTAINED FROM THE USE OF THE SOFTWARE OR AS TO THE ACCURACY OR RELIABILITY OF ANY INFORMATION OBTAINED THROUGH THE SOFTWARE OR THAT DEFECTS IN THE SOFTWARE WILL BE CORRECTED. THE COMPANY EXPRESSLY DISCLAIMS ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED OR STATUTORY, INCLUDING, BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF TITLE, MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT. THE COMPANY MAKE NO WARRANTY REGARDING ANY GOODS OR SERVICES PURCHASED OR OBTAINED THROUGH THE SOFTWARE OR ANY TRANSACTIONS ENTERED INTO THROUGH THE SOFTWARE. NO ADVICE OR INFORMATION, WHETHER ORAL OR WRITTEN, OBTAINED BY END USER FROM THE COMPANY SHALL CREATE ANY WARRANTY NOT EXPRESSLY MADE HEREIN.

5.LIMITATION OF LIABILITY AND INDEMNITY
THE COMPANY WILL NOT BE LIABLE FOR ANY LOSS OF USE, INTERRUPTION OF BUSINESS, OR ANY INDIRECT, SPECIAL, INCIDENTAL, OR CONSEQUENTIAL DAMAGES OF ANY KIND (INCLUDING BUT NOT LIMITED TO LOST PROFITS) REGARDLESS OF THE FORM OF ACTION, WHETHER IN CONTRACT, TORT (INCLUDING NEGLIGENCE), STRICT PRODUCT LIABILITY, OR OTHERWISE, EVEN IF THE COMPANY HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

6.ERM AND TERMINATION
Either End User or The Company may terminate the Software with or without cause at any time. The Company shall not be liable to End User or any third party for termination of Software. Upon termination of the Service, End User's right and license to use the Software immediately cease. End User shall have no rights and uninstall the software. The Company will have no obligation thereafter to provide services specified under this EULA to End User or any third party.
