The Bible App for Kids Terms of Use

1. Acceptance of Terms

By installing, using or accessing this application, you acknowledge that you have read and agree to be bound by the Bible App for Kids TERMS OF USE. LifeChurch.tv provides services on the Internet, the World Wide Web (the ‘Web’) and mobile devices including the Bible App for Kids application and the Bible App at http://bible.com (collectively, ‘the Bible App for Kids’), which are subject to the following TERMS OF USE. LifeChurch.tv may update the TERMS OF USE from time to time, without notice. When using the Bible App for Kids, you shall also be subject to any additional guidelines or rules which may be posted from time to time on the Bible App for Kids application under the About section. All such guidelines or rules are hereby incorporated by reference into these TERMS OF USE. Violations of these TERMS OF USE should be reported via email to legal@youversion.com.

2. Description of Service

LifeChurch.tv provides Users with access to the Bible App for Kids at no charge to the user. By using the Bible App for Kids, you understand that such usage may include communications from LifeChurch.tv, including but not limited to service announcements, administrative messages, and other messages to which you have individually subscribed. You understand and agree that you are responsible for obtaining access to the Bible App for Kids, which may involve equipment and third-party fees (such as Internet service provider fees, airtime charges, or other charges associated with the display and delivery of messages).

3. Your Registration Obligations

LifeChurch.tv is concerned about the safety and privacy of all its users, particularly children. For this reason, parents of children under the age of 13 who allow their children to access the Bible App for Kids must acknowledge that the Bible App for Kids is designed to appeal to a broad audience. Accordingly, as your child’s legal guardian, it is your responsibility to determine whether the Bible App for Kids is appropriate for your child.

4. The Bible App for Kids Privacy Policy

Registration Data and other information is subject to our Privacy Policy located within the Bible App for Kids About section. You understand that through your use of the Bible App for Kids you consent to the collection and use (as set forth in the Privacy Policy) of this information, including the transfer of this information to the United States and/or other countries for storage, processing and use by LifeChurch.tv.

5. Member Conduct

LifeChurch.tv provides the Bible App for Kids for uncompensated, personal, and intangible spiritual and/or religious benefit.

You understand that the technical processing and transmission of the Bible App for Kids may involve

transmissions over various networks; and
changes to conform and adapt to technical requirements of connecting networks or devices.
6. Global Nature of Communications

You acknowledge that in using the Bible App for Kids, you will be causing communications to be sent through LifeChurch.tv’s computer networks, portions of which are located throughout the globe. As a result, even communications that seem to be intrastate in nature can result in the transmission of interstate and global communications regardless of where you are physically located at the time of transmission. Accordingly, you acknowledge that use of the Bible App for Kids results in interstate and global data transmissions. Specifically, you agree to comply with all applicable laws regarding the transmission of technical data exported from the United States or the country in which you reside.

7. Contributions to the Bible App for Kids

By submitting ideas, suggestions, documents, and/or proposals (‘Contributions’) to the Bible App for Kids, you acknowledge and agree that:

your Contributions do not contain confidential or proprietary information;
LifeChurch.tv is not under any obligation of confidentiality, express or implied, with respect to the Contributions;
LifeChurch.tv shall be entitled to use or disclose (or choose not to use or disclose) such Contributions for any purpose, in any way, in any media worldwide;
LifeChurch.tv may have something similar to the Contributions already under consideration or in development;
your Contributions automatically become the property of LifeChurch.tv without any obligation of LifeChurch.tv to you; and
you are not entitled to any compensation or reimbursement of any kind from LifeChurch.tv under any circumstances.
8. Indemnity and Release of Liability

You agree to indemnify and hold LifeChurch.tv and its subsidiaries, affiliates, officers, agents, employees, partners and licensors harmless from any claim or demand, including reasonable attorneys’ fees, made by any third party due to or arising out of your use of the Bible App for Kids, your connection to the Bible App for Kids, your violation of the TERMS OF USE, or your violation of any rights of another. You expressly understand and agree that LifeChurch.tv and its subsidiaries, affiliates, officers, employees, agents, partners and licensors make no warranty that:

the Bible App for Kids will meet your requirements;
the Bible App for Kids will be uninterrupted, timely, secure or error-free; and
the results that may be obtained from the use of the Bible App for Kids will be accurate or reliable.
9. No Resale of Service

You agree not to reproduce, duplicate, copy, sell, trade, resell or exploit for any commercial purposes, any portion of the Bible App for Kids (including your LifeChurch.tv ID), use of the Bible App for Kids, or access to the Bible App for Kids.

10. General Practices Regarding Use

You acknowledge that LifeChurch.tv may establish, and modify from time to time, general practices and limits concerning the use of the Bible App for Kids.

11. Modifications to Service

LifeChurch.tv reserves the right at any time and from time to time to modify or discontinue, temporarily or permanently, the Bible App for Kids (or any part thereof) with or without notice. You agree that LifeChurch.tv shall not be liable to you or to any third party for any modification, suspension or discontinuance of the Bible App for Kids.

12. Termination

You agree that LifeChurch.tv may, for any reason or no reason and without prior notice, at its sole discretion, immediately terminate access to the Bible App for Kids at any time and for any reason, and shall not be liable to you or any third party for any termination of your access to the Bible App for Kids.

13. Dealings with Third Parties

You acknowledge that your dealings with any parties met or found through the Bible App for Kids are solely between you and such party. You agree that LifeChurch.tv shall not be responsible or liable for any loss or damage of any sort incurred as the result of any such dealings.

14. Links

The Bible App for Kids may provide links to World Wide Web sites or resources. You acknowledge and agree that LifeChurch.tv has no control over, is not responsible for the availability of, and does not endorse and is not responsible or liable for, any Content, advertising, products or other materials on or available from such sites or resources. You acknowledge and agree that LifeChurch.tv is not responsible in any way for any damage or loss caused by or in connection with use of or reliance on any such site or resource.

15. Proprietary Rights

You acknowledge and agree that the Bible App for Kids contains proprietary and confidential information that is protected by copyrights, trademarks, service marks, patents, intellectual property laws, or other proprietary rights and laws. Except as expressly permitted by applicable law or authorized by LifeChurch.tv, you agree not to copy, modify, rent, lease, loan, sell, distribute, publicly display, publicly perform or create derivative works based on the Bible App for Kids, in whole or in part.

16. Limitation of Liability

You expressly understand and agree that LifeChurch.tv and its subsidiaries, affiliates, officers, employees, agents, partners and licensors shall not be liable to you for any direct, indirect, incidental, special, consequential or exemplary damages, including, but not limited to, damages for loss of profits, goodwill, use, data or other intangible losses (even if LifeChurch.tv has been advised of the possibility of such damages), resulting from:

the use or the inability to use the Bible App for Kids;
unauthorized access to or alteration of your transmissions or data; or
any other matter relating to the Bible App for Kids.
17. No Third-Party Beneficiaries

You agree that, except as otherwise expressly provided within these TERMS OF USE, there shall be no third-party beneficiaries to this agreement.

18. Notice

LifeChurch.tv may provide you with notices, including those regarding changes to these TERMS OF USE, including but not limited to email, regular mail, SMS, MMS, text message, postings on the Bible App for Kids, or other reasonable means now known or hereinafter developed.

19. Trademark Information

The trademarks, logos, service marks, and product and service names related to LifeChurch.tv and its ministries are trademarks of LifeChurch.tv (the ‘LifeChurch.tv Marks’). Without prior written permission from LifeChurch.tv, you agree not to display or use the LifeChurch.tv Marks in any manner.

20. General Information

Entire Agreement. This TERMS OF USE constitutes the entire agreement between you and LifeChurch.tv and governs your use of the Bible App for Kids, superseding any prior agreements between you and LifeChurch.tv with respect to the Bible App for Kids. You also may be subject to additional terms and conditions.

Choice of Law and Forum. The TERMS OF USE and the relationship between you and LifeChurch.tv shall be governed by the laws of the State of Oklahoma without regard to conflict of law provisions. You and LifeChurch.tv agree to submit to the personal and exclusive jurisdiction of the courts located within the county of Oklahoma County, Oklahoma.

Waiver and Severability of Terms. The failure of LifeChurch.tv to exercise or enforce any right or provision of these TERMS OF USE shall not constitute a waiver of such right or provision. If any provision of these TERMS OF USE is found by a court of competent jurisdiction to be invalid, the parties nevertheless agree that the court should endeavor to give effect to the parties’ intentions as reflected in the provision, and the other provisions of these TERMS OF USE remain in full force and effect.

Statute of Limitations. You understand and agree that regardless of any statute or law to the contrary, any claim or cause of action arising out of or related to use of the Bible App for Kids or these TERMS OF USE must be filed within one (1) year after such claim or cause of action arose or be forever barred.
